First post...be kind! This happened way back in the dark ages, 1986. I was 21 at the time and working for a gas station that was associated with a certain grocery store chain in Washington state. It was owned by a company not affiliated with said chain, but had locations at nearly every one.
As this was long before the days of debit cards, this was a cash only gas station. We didn’t even take credit cards. Customers would pull up, pump their gas and then come to my window to pay. We also sold cigarettes. No drinks, no snacks...customers couldn’t even get into my booth. I had been working there about a year when the company announced it was closing the location. My manager and I were offered positions at another location upstate and we both accepted. We moved our respective families and started our new jobs. As new hires (ugh).
This station was incredible busy. We did more business in 8 hrs than my old location would do in a week. This location also had a different set up: here you would pull into the station from a single entrance, pump your gas, and then drive forward to a single exit where the “Pay Here” booth was located. There were always 2 cashiers on duty. Each cashier had a cash drawer.
One thing I should note, there were also no computers. So closing the drawer down between shifts was timing consuming and tedious. We had to manually count the cigarettes remaining, and count the cash drawers. We would fill out an end of shift report listing the starting balances and the ending balances. We also had to list the gallons sold from each pump. At the end of the shift the total of gallons sold and the total cigarettes sold should equal the cash balance. It is important to note here that not once in the year I had worked for the previous location had I been off by more than 10 cents.
The following morning after my first shift I was informed by the manager that I was short $50. Impossible I said, I balanced out yesterday. He said that I must have stolen that money after I had completed the paperwork. I just looked at him and said, no I didn’t. He gave me a verbal warning and said if it happened again I would be fired and the stolen money would be deducted from my paycheck this week.
In the 5 days that followed I realized quickly the manager was up to something. My old manager who was just another worker now, was also accused of stealing. As was one other new employee. I can’t vouch for the other employee but I’m pretty sure she did nothing wrong. The employees that had been there awhile were never accused of anything. I did some checking and found out this manager was relatively new (had only been there about 6 months) and the other cashiers had been here before him. Only new cashiers were being accused of stealing. And that location had been having “stealing problems” for about 6 months and the turnover was high with the new employees.
I came to work at 6am on a Monday only to be told I was being fired. For cause. The manager accused me of taking $500 out of my drawer the previous Friday. He said he only discovered it this morning (even though he had worked Sat and Sun). I said ok and left. I was pretty angry and instead of going home, I parked in the grocery store parking lot and proceed to settle in to watch the gas station. I knew that at 9am sharp, he would take the cash in the safe and make the weekend deposit. At 9am he left the gas station and headed to the bank. But instead of walking into the bank, he walked into the Indian “casino” next door. It’s not really a casino like we think of today, but more of a betting parlor for the races. It did have slot machines, but no card tables.
I think “Well, this is interesting”.
He comes out of the casino at exactly 10 am, walks next door to the bank, does his business and then heads back to the gas station. I head home with a plan.
Every morning I follow him from the gas station to the casino. I take a picture of him leaving, and one of him arriving at the bank and walking into the casino. I take pictures of him coming out and then heading to the bank. I do this for 5 days straight. He even went on Saturday. On day 3 my old manager was fired for “stealing” $150.
I get the film developed (no digital camera in the dark ages) note the times and dates on the back of each one. Then I call the main office of the gas company. It’s after 5 but I’m hoping someone is there. And there is. I speak to a woman and explain my situation and she says she knows exactly who I should speak to and transfers me. By some grace of God, she has transferred me to none other than the President/CEO of the company!
I tell him my story and tell him I did NOT steal from his company and could prove who actually did. He took down my information and said he would be in touch. I’m thinking to myself “yeah right”. The next morning I went to the station to perform my usual observation of the manager. At 9am he leaves for the “bank”. At 10 am he comes out. At that moment 2 stern looking gentlemen approach him. One pulls out his wallet and shows him something. The other one is talking. The manager goes pale and takes a step back. Next thing I know he is being escorted to a car I hadn’t noticed and they drive off. I lose them at a traffic signal so I head back to the station. They all show back up about 5 min later, and a few minutes after that a police cruiser pulls in. The officer talks to the stern gentleman and proceeds to place the manager in handcuffs. The other man says nothing but is glaring daggers at the manager.
The President called me later that after noon and informed me that the manager had been arrested for embezzlement (turns out that in 6 months he had managed to steal about $5k). He would take the store cash into the casino and gamble with it; if he won, he would make the normal bank deposit. If he lost, he would make the deposit and note in his records that we had been short the previous day. The CEO had already been focusing on that location because of the stealing and high turnover rate, but my information helped them figure out what exactly had been going on.
I was thanked and sent a substantial check as a reward. My old manager was offered the manager’s job and I was offered my old job back. I declined as I had already found another job that I liked more and paid better. The gambling manager was sentenced to 1 year in jail and ordered to attend counseling for his gambling addiction. His wife divorced him and took their 3 children to California. His house was foreclosed on and he ended up in a homeless shelter.
Don’t accuse me of stealing. I will get revenge.

Two Views of Survey Data: The Modal Motte User | A Ranking of Everything, From Scott Alexander to Stalin

A few survey results are still trickling in (you can still take it if you'd like; I've yet to formally close it and upload the csv file), but it's reached about 1/10 of the subreddit subscribers at this point, which should be more than enough to begin to draw some conclusions and have some fun with the data. To begin the process of analysis, here are two of the simpler ways to look at it:
A Ranking of Everything
On the survey, I included an interminably long set of questions inviting everyone to rank a wide range of people and topics on a five-point scale as compared to others in similar positions. Now that I have that data, I thought it best to blatantly misuse it to compare the incomparable. If you've ever wanted to know whether the Motte prefers the furry fandom or an increased military budget, or what it would choose between gay rights and the Wall Street Journal, here's your chance. Presenting: A Ranking of Everything, From Scott Alexander to Stalin.
The other half of this post is a more straightforward reading of the data, a view of exactly the sort of person this place attracts:
The Modal Motte User
The modal Motte user is a 29-year-old, right-handed straight white man with a Bachelor's degree, a US citizen who lives in California. He has finished his formal education and now earns around $65000 a year, though his net worth remains under $10000. He is single with no kids for now, but he plans on having 2 kids eventually. He is not affiliated with any political party. He was raised Catholic, but now considers himself an atheistic humanist. He considers himself a capitalist, a libertarian, and a classical liberal. He got 800s in both SAT-math and SAT-verbal, but despite this scored only a 1500 overall. He scored a 33 on his ACT. Per the MBTI, he's on the border between INTJ and INTP, which breaks out more clearly in the OCEAN model with very high openness to experience, average agreeableness and conscientiousness, slightly below average extraversion, and low negative emotionality.
He's worn glasses since childhood, had a hundred books or so in his childhood home, and mostly read for pleasure as a kid, though he also enjoyed video games, TV, and playing outside. He went to public school, but didn't like it. Now, he spends 8-12 hours in front of a screen daily, reads hours of longform text each day, and generally also watches videos and plays games. He sleeps about seven and a half hours nightly, and has not had the pleasure of a lucid dream. He lives in a city, but hasn't yet been convinced of the joys of living in a cyberpunk dystopia and prefers outdoor activities to city ones.
He is convinced the dress is blue and black and the voice says Laurel. He used to be a Star Wars fan but has never liked Marvel or Game of Thrones. He's been known to watch anime on occasion. He has never been to a Renaissance Faire, a Comic-Con, or a video game tournament, and has no desire to do so. He's also not a committed enough anthropologist to attend a furry convention. Catcher in the Rye is his least favorite book.
He cooperates in prisoner's dilemmas, would offer a stranger a fair split of found money, and would take the stranger up on their offer even with an unfair split. He's oddly reluctant to participate in the Stanford Prison Experiment. At least he knows how much a pile of cucumbers weighs, though. He thinks it's only acceptable to shoot a stranger who's broken into his house if they pose a clear threat to his life or those of his loved ones, thinks cannibalistic shipwrecked sailors are immoral but should not be punished, and might gossip depending on circumstances. According to him, "racecar" is a good palindrome, though when it comes to pangrams he's more partial to sphinxes of black quartz, and he turns towards Rudyard Kipling for good poetry.
In 2016, he voted for Hillary Clinton, and in 2020 he plans to vote for Joe Biden, though if he were in the UK he would support Boris Johnson.
He believes his country should not increase immigration rate, but should move towards freer trade. He thinks the current abortion laws are more-or-less reasonable and his country should consider moving towards single-payer healthcare, though he's not adamant about it. He hopes to avoid stricter regulation on tech companies and budget increases for the military or education, strongly opposes gun control, wants looser IP laws, and hopes to see fewer legal restrictions on drug use. He believes we have done enough for gay rights at this point and strongly believes we do not need to do more for trans rights. He is ambivalent about a need to support religious freedom. He sees a need for aggressive action against climate change, supports further investment in public transport, and is generally in favor of higher taxes on the wealthy. He's cautiously against a universal basic income, is ambivalent about the need for a more comprehensive safety net, and would like to see the government shrink.
As far as personal beliefs goes, he thinks people should perhaps eat less meat, but sees no ethical issue with consuming animal products. He has moral qualms about late-term abortion, but not most drug use. He believes strongly that socialization is not the primary cause of differences between men and women and that there is no need for greater gender balance in STEM professions, also holding with a bit less certainty that we should not aim for greater gender balance among schoolteachers. He believes that prejudice against Christians, women, men, and minorities are not serious problems in the US today, though he's less confident about the later groups on the list. He is extremely confident IQ tests measure something real and important and confident that intelligence differs between ethnic groups, though is uncertain whether they are primarily genetic in origin. He does not believe we should limit immigration from countries with low average IQ.
He is weakly confident that sex and gender are distinct, and more certain that there are only two genders. He does not consider trans women to be women, but believes you should use someone's preferred pronouns if requested. He is confident gay marriage is morally no different than straight marriage, but believess with equal certainty that a baker should be allowed to refuse to bake a cake for a gay wedding. He sees promoting the family unit as important for a healthy society, is conflicted but ultimately weakly against polyamorous relationships, and sees nothing wrong with consensual pornography. He's torn on the morality of casino gambling but ultimately feels it's not a moral concern. He is certain that anthropogenic climate change is occurring, and weakly confident it is a catastrophic problem. He feels strongly that capitalism is the best economic system available and is largely ambivalent on regulation, ultimately weakly opposing it. He is skeptical of centralized government and ambivalent about religion, seeing it as a weak force for good.
He thinks human genetic engineering is a good idea and rejects the idea that people in developed countries should have fewer children, but agrees that people in developing countries should do so. He sees a problem with consumerism in our society, believes modern architecture is worse than traditional architecture and modern art is worse than traditional art, and thinks the West is in decline. He believes we are no more or less moral now than at any point in history, but is certain we are better off than ever before, and thinks humanity's future is bright.
He hates Donald Trump, dislikes Mike Pence, and is largely ambivalent but weakly against Mitt Romney and Joe Biden. He likes neither Mitch McConnell or Nancy Pelosi, hates Elizabeth Warren, Ilhan Omar, Alexandria Ocasio-Cortez, and Hillary Clinton, and is torn on Bernie Sanders but leans towards dislike. He likes Andrew Yang quite a bit and sort of likes Tulsi Gabbard.
As far as past presidents go, he likes Obama but not Bush, is ambivalent about Clinton, Bush the Elder, and Reagan, dislikes Nixon, doesn't care about Lyndon B Johnson, is torn but ultimately favorable towards FDR, is ambivalent about Herbert Hoover, likes Theodore Roosevelt, loves Abraham Lincoln, hates Andrew Jackson, likes Thomas Jefferson, and would march into battle for George Washington.
What about world figures? He's ambivalent about Boris Johnson but quite likes that Cummings chap who advises him, strongly dislikes Jeremy Corbyn, is ambivalent but weakly against Macron, ambivalent towards Merkel, against Netanyahu and Modi (though he doesn't know much about the latter), and is aggressively against Putin, Xi Jin Ping, Nicolas Maduro, and particularly Kim Jong Un. He carelessly has no opinion yet on Tsai Ing-Wen.
Rather predictably, he unconditionally hates Stalin, Hitler, bin Laden, and Mao. He likes Nelson Mandela and Winston Churchill, loves Lee Kuan Yew but hasn't yet learned just how great he is, is ambivalent but weakly positive towards Thatcher and weakly negative towards Blair.
The only cultural commentator he really likes is Scott Alexander, but he's also favorably inclined towards Bryan Caplan, Paul Graham, Eliezer Yudkowsky, and Freddie deBoer--if he thinks about them at all. He kinda likes Joe Rogan, Jordan Peterson, and Sam Harris, but doesn't feel strongly. He doesn't really like Ben Shapiro, can't stand Richard Spencer or Alex Jones, mostly dislikes Steven Colbert and Jon Stewart, and likes Hitchens. Many other figures labor in obscurity even in this obscure corner. Those who know about Moldbug are torn on him but weakly favorable, the fewer who know about Bronze Age Pervert are largely against him, and Steve Sailer gets weak positive ratings and a lot of uncertainty. He's not too keen on Contrapoints or Tucker Carlson, and doesn't like Steven Crowder assuming he thinks about him at all. If he's heard of Nick Fuentes, he can't stand him.
News organizations don't fare much better. He only really likes FiveThirtyEight, The Economist, and the Wall Street Journal, and he'll give a weakly favorable shrug to The Atlantic. He's not keen on the NYTimes, Washington Post, The Guardian, or The Intercept (if he cares at all about it). Everything else, he can't stand: CNN, MSNBC, Fox News, Vox, Breitbart, Jacobin, Chapo Trap House, The Young Turks. He doesn't often think about Drudge Report, OANN, or BreadTube, but he hates the lot.
And what of movements? He dislikes Black Lives Matter, the trans rights movement, gender-critical feminism, gun control, the pro-life movement, the furry fandom, and open borders. He can't stand intersectional feminism, white identitarianism, antinatalism, or social justice. He is ambivalent about animal rights and ambivalent leaning towards positive about the gay rights movement, second-wave feminism, and the pro-choice movement. He kind of likes the religious freedom movement and likes gun rights. He strongly supports Effective Altruism and would march in Hong Kong with the protesters there if he could.
He's participated in the Motte since the days of the SSC Culture War Thread, at least three years now, and thinks it's stayed pretty much the same since then. He sees himself as rationalist-adjacent though wouldn't personally identify as one, likes and regularly reads Slate Star Codex, and comments on the Motte occasionally. He's never been warned or banned, but then again, he doesn't often comment. He thinks the rules are neither overly permissive or strict, sees them as generally clear, effective, and consistent, and doesn't see a left or right bias in moderation (...well, he says, maybe a tiny leftward bias). Meanwhile, he sees the culture as friendly and ideologically diverse (if right-biased), and thinks it provides accurate information, but sees it as a bit repetitive. He mixes zontargs and zortlax up even though zontargs has since left for greener pastures.
Alarmingly, he has not yet stopped beating his wife.

[S] Capy's Survivor: One World (S24)

Hello! Welcome or welcome back to Capy's Survivor! We are once again playing the game of outwitting, outplaying, and outlasting your fellow castaways, whether that be by flirtatious behavior, backstabbing your opponents, or making plenty of allies. 18th - The Manono tribe quickly became a world divided (ironic) as R2, Forrest, and Michael decided to form a Final 3 pact. The others heard of this, and Brett, Carter, Harley, Karl, and Shawn formed another alliance to counter it. Zed decided to stay on the outside, as he didn’t feel comfortable aligning with anyone this early. Since they had majority, the 5-person alliance decided to try to take the easy way out, and vote for the leader of the opposing alliance, R2. Little did they know, R2 had an idol, sending Karl packing in a 5*-4 vote. Eliminated: Karl
17th - Much like their fellow tribe, Salani also became a war between 2 alliances, those being Angel-Tori-Toni and ChadBane-Josie-Katrina. Knowing flippers are dangerous, ChadBane-Josie-Katrine decided to vote out one of the swing votes, Lela. Angel-Tori-Toni decided on Katrina, seeing her as a goat to the opposite side, which they did not want moving ahead, they obviously managed to get Lela’s vote. But, ChadBane, Katrine, and Josie managed to convince the other 2, Dixie and Ximena, to flip to their side. Sending Lela packing 5-4. Eliminated: Lela
16th - Manono was back to tribal council. It was a tribe divided between Brett-Carter-Harley-Shawn and Forrest-Michael-R2, alongside swing vote Zed. Zed decided to stick with the 3, because the other 4 were being bullies among the tribe, and just seen as threats. Both sides decided to vote the opposing sides leader-figure, being R2 and Brett. It was a 4-4, but Shawn realized he was only hurting his game by staying loyal to the alliance, so he decided to flip. Sending Brett home on a 4-4; 4-2 vote. Eliminated: Brett.
15th - Salani was back at tribal. The alliances were still going strong. With Ximena and Dixie still in the middle. But, Ximena was trying to be a villainous switch, and the 2 alliances said they only needed 1 swing vote to gain a majority, and that Ximena was being untrustworthy, and they can’t keep someone like that until the merge, because she just had a clashing personality with the rest of the tribe, and it wasn’t sitting well. But, little did they know, Ximena had an idol. So she decided that Toni was her biggest adversary currently in the game, and personally. So she sent her home 7*-1. Eliminated: Toni.
14th - A tribe swap occurs, putting Angel, Dixie, Josie, Katrina, Michael, Tori and Zed onto Manono. With Carter, ChadBane, Forrest, Harley, R2, Shawn, and Ximena on Salani. Salani wins the first post-swap immunity, sending Manono to Tribal Council. Ximena manages to find the Salani idol, meaning Forrest (who found the original Manono idol) and Ximena have idols. At the Manono camp, Tori is already making bad first impressions on Michael and Zed, when they approach the other woman, they agree that they need to take her out. But this is secretly just because the other woman just don’t get along well with Tori, and they don’t want her putting the woman at a disadvantage in the future. So by a unanimous vote of 6-1, Tori is sent packing. Eliminated: Tori.
13th - Salani wins another immunity challenge, sending Manono back to the tribal council. Where Zed and Angel have a fight, and the rest of the tribe has had enough of their little rivalry. But, wanting to be in the good with the men coming into the merge, Josie, Dixie, and Katrine decide it will be the best to vote Angel out, even if it does give them a slight disadvantage. Angel goes out in a 4-2. Eliminated: Angel
12th - The merge occurs, which means Carter, ChadBane, Dixie, Forrest, Harley, Josie, Katrina, Michael, R2, Shawn, Ximena, and Zed made the merge. Katrina wins the first immunity challenge. Back at camp, being very divided during the swap, the alliance of Josie, Michael, Zed, Katrina, and Dixie quickly dissolves. Everyone is targeting Ximena, not knowing she has another idol. But Zed wants to try and help a fellow former swing vote. So he tries to rally the girls in an attempt to boot a guy, but they don’t listen. It was a 10-2 for Ximena, but she uses her idol. Blindsiding Carter. Eliminated: Carter.
11th - ChadBane wins the immunity challenge. Knowing there is no hope anymore for Ximena, Zed decides to try to decrease the target on his back by flipping back over to the other side of the vote, as he knows there is no way he will get votes. Ximena goes out in a 10-1 vote. Eliminated: Ximena
10th - ChadBane wins their second immunity in a row. Back at camp, in an attempt to improve his social game, Zed goes and talks to Josie, and they end up bonding a lot. The girls decide that they need to stop trying to vote out their own, as they are down 6-4 in numbers. Luckily for them, R2, Forrest, and Michael decide it will be for the best to vote out Shawn, as he is doing good in the challenges and has a natural charm. They manage to get Zed on board, as he feels like he is on the outside. The women feel like this is a perfect opportunity to take. Shawn is blindsided 8-2. Eliminated: Shawn.
9th - ChadBane wins their third immunity in a row. Seeing him as a major social and strategic threat on the other side, the girls decide that R2 is their biggest adversary. R2 is also targeting Dixie with all the guys because she is seen as a goat to some of the girls, and she can’t make it to the end. Zed ends up flipping in favor of the girls, as he sees R2’s threat level, and is still trying to seal cracks from defending Ximena. But, R2 knows that the girls being quiet towards his is probably not a good sign, and plays his new-found idol just in case. Blindsiding Dixie 5*-4. Eliminated: Dixie.
8th - R2 manages to win immunity, foiling Zed and the girl’s plans of attempting to flip someone in a tie. The girls decide to target R2’s right hand man, Harley. While the guys decide that challenge beat, ChadBane is their biggest target. Zed, the swing vote, is thinking. now with the girls being in a minority instead of a tied majority, and him seeing ChadBane as a bigger threat, he decides to flip back with the guys. Yet another blindside, with ChadBane going out 5-3. Eliminated: ChadBane.
7th - R2 snags another immunity win. Zed is attempting to reconcile his relationship and alliance with Michael. It works, and he manages to convince Michael that they are not priority, that they are not the priority with the guys, and they will take them out whenever they have a chance. They decide that going with the girls target of Forrest would be good. R2, Forrest, and Harley figure that this is happening, as Michael has been strangely quiet towards them. R2 decides that they are too smart to go for the same target twice in a row, and he tells Forrest to play his idol on himself. He does, blocking 5 votes, and blindsiding Josie. Eliminated: Josie.
6th - Katrina wins her second immunity, pitting the guys against each other. Both alliances approach Katrina, with Zed-Michael targeting R2, and R2-Forrest-Harley targeting Michael. Katrina decides that taking the risky move, and forcing a tie with R2 and Michael is the best bet, as someone might flip to their side, seeing as R2 is a major threat. It does tie, Zed and Katrina know that flipping to Michael is very stupid. Forrest and Harley decide that, even though he is a threat, they will make it farther in the game with R2, and having an 100% chance of losing an ally is better than a 50% chance, it ties again. Forrest, Harley, and Zed draw rocks. Forrest draws the black rock, and is promptly eliminated. Eliminated: Forrest.
5th - R2 wins his third immunity. But, he is also panicking, as he just lost one of his intended goats, and might not be able to save his other, Harley. He gathers Zed, Michael, and Harley and tell them that they need to stick with their original alliance. Michael and Zed find this plan good, as it guarantees them a spot. But, they didn’t expect that R2 does not trust them, and he knows Michael is well spoken, and a jury threat. So he decides last-minute to round up Katrina and Harley to blindside him. Michael joins the many people blindsided this season, going out in a 3-2. Eliminated: Michael.
4th - R2 manages to win Final Immunity, which means he won 4 immunities in all. Wanting his game-long enemy, Zed, out R2 decides that even though bringing Katrina will lose him a few votes, he should take Zed out just in case. Zed is the last one to go home by a 3-1 vote. Eliminated: Zed.
Final Tribal Council - R2 manages to win by a vote of 7-2-0, for his well-rounded game, winning 4 immunities, being one of the better strategists this season, orchestrating many blindsides, and playing a great social game. Katrina manages to gather 2 because of her challenge wins and because Dixie and ChadBane were bitter about how they went out. Harley did…. pretty much nothing, so he didn’t get any votes.
My thoughts - One of the better seasons in a while. Dominant winner, but also well-rounded. Definitely deserved it. The sheer amount of blindsides and people getting idoled out was overwhelming at times, but also fun to watch. With being on the bottom of the totem pole the whole game, Zed really managed to work it out, I would’ve liked to see a Katrina-Zed-R2 Final 3. I would like to see how that would work out. All-in-all, a good season. I give it a 6.5/10.

Figuring out how to divide the COVID-19 content from the “regular” news has been difficult because the pandemic is influencing all aspects of life. Some of the stories below involve the virus, but I chose to include them when it fits into one of the pre-established categories (like congress or immigration). MAIN COURSE

Congress passes stimulus

Last week started out with a Republican-crafted stimulus bill that was twice-blocked by Senate Democrats, who objected to the lax conditions of aid to corporations, too little funding for hospitals, and a $500 billion “slush fund” for big companies to be doled out by Treasury Secretary Steve Mnuchin with no oversight.
Conservative-Democrat Joe Manchin (WV) even criticized the GOP bill:
“It fails our first responders, nurses, private physicians and all healthcare professionals. ... It fails our workers. It fails our small businesses… Instead, it is focused on providing billions of dollars to Wall Street and misses the mark on helping the West Virginians that have lost their jobs through no fault of their own.”
Through negotiations, Democrats shifted the bill in a more-worker friendly direction. The version that passed includes the following Democrat-added provisions: expanded unemployment benefits, $100 billion for hospitals, $150 billion for state and local governments, direct payments to Americans without a phase-in (ensuring low-income workers get the full amount), a ban on Trump and his children from receiving aid, and oversight on the “slush fund” (see next section for more info). Senate Democrats also managed to remove a provision that would have excluded nonprofits that receive Medicaid funding from the small-business grants.
Echoing sentiments expressed during debate on the previous coronavirus bill (the second, for those keeping track), Republican senators derided the $600 a week increase in unemployment payments as “incentivizing” workers to quit their jobs. Sens. Ben Sasse (Neb.), Rick Scott (Fla.), Tim Scott (S.C.) and Lindsey Graham (S.C.) delayed passage of the bill in order to force a vote on an amendment removing the extra unemployment funding. "This bill pays you more not to work than if you were working," Graham said. Fortunately for American workers, the amendment failed and the improved bill passed the Senate and the House.

The giveaways in the bill

While Senate Democrats were able to add worker-friendly provisions, the bill still required bipartisan support to pass the chamber and some corporate giveaways remained in the final version.

Trump’s signing statement

While signing the latest coronavirus relief bill, the president also issued a signing statement undercutting the congressional oversight provision creating an inspector general to track how the administration distributes the $500 billion “slush fund” money.
The newly-created inspector general is legally required to audit loans and investments made through the fund and report to Congress his/her findings, including any refusal by the executive office to cooperate. In his signing statement, Trump wrote that his understanding of constitutional powers allows him to gag the special IG:
"I do not understand, and my Administration will not treat, this provision as permitting the [inspector general] to issue reports to the Congress without the presidential supervision required" by Article II of the Constitution.
The signing statement further suggests that Trump does not have to comply with a provision requiring that agencies consult with Congress before it spends or reallocates certain funds: "These provisions are impermissible forms of congressional aggrandizement with respect to the execution of the laws," the statement reads.
While some have said that Congress fell short in this instance, one Democratic Senate aide told Politico that Congress built in multiple layers of oversight, including “a review of other inspectors general and a congressional review committee charged with overseeing Treasury and the Federal Reserve's efforts to implement the law.”
Legal experts have pointed out that a signing statement is “without legal effect.” But that ignores the fact that oversight is not equal to enforcement. The problem, in my opinion, isn’t that Congress won’t be notified of any abuses of power by Trump. The problem is that congressional Republicans and the judiciary have largely failed to hold him accountable and enforce our laws even after learning of his abuses.

Concerns about the IG

Another potential weakness in the oversight structure is the inspector general position itself. The special inspector general for pandemic recovery, known by the acronym S.I.G.P.R., is nominated by the president and confirmed by the Republican-controlled Senate. As we’ve seen from Trump’s previous nominees, particularly judicial, many unqualified individuals have been confirmed. The Democrats will not have the power to stop the president and Mitch McConnell from jamming through a loyalist to fill the SIGPR role.
Former inspector general at the Justice Department Michael Bromwich: “The signing statement threatens to undermine the authority and independence of this new IG. The Senate should extract a commitment from the nominee that Congress will be promptly notified of any Presidential/Administration interference or obstruction.”
You may recall that Trump has already proven that he’s willing to interfere with the legally-mandated work of an inspector general. When the Ukraine whistleblower filed a complaint last year, the IG of the Intelligence Community, Michael Atkinson, investigated and determined the complaint to be “urgent” and “credible.” Atkinson wrote a report and gave it to Director of National Intelligence Joseph Maguire to hand over to Congress. However, the White House and DOJ interfered and instructed Maguire not to transmit the report to the Senate and House Intelligence Committees. Chairman Adam Schiff had to subpoena Maguire to turn over the report and testify before his committee.
Further, there are already five IG vacancies in agencies that have a critical role in responding to the pandemic. The Treasury itself has not had a permanent, Senate-confirmed IG for over eight months now, and Trump hasn’t nominated a replacement. The Treasury Dept. has taken a lead role in the coronavirus response, with Secretary Mnuchin handling most of the negotiating with Congress on Trump’s behalf. The fact that the lead agency doesn’t have IG oversight should be troublesome in itself; replicating the situation with a special IG doesn’t seem to be a promising solution.
UPDATE: The nation's inspectors general have appointed Glenn Fine, the Pentagon's acting IG, to lead the committee of IGs overseeing the coronavirus relief effort.
This is one of several oversight mechanisms built into the new law. They include:
A committee of IGs (now led by Fine), a new special IG (to be nominated by Trump), a congressional review panel (to be appointed by House/Senate leaders)

Direct payments

Included in the stimulus bill is a $1200 one-time direct payment for all Americans who made less than $75,000 in 2019 (less than $150,000 if couples filed jointly). More details can be found here. I have read that the Treasury will use 2018 information for those who have not filed yet this year, but I am not 100% sure that’ll happen.
Mnuchin has said that Americans can expect to receive the money within three weeks, but many experts expect that timetable to be pushed into late April. Additionally, that only applies to Americans who included direct deposit information on their 2019 tax returns. Those who did not include their bank’s information will have to be sent a physical check in the mail… which could take anywhere from two to four months.
Other options are being discussed, including partnering the Treasury Dept. with MasterCard and Visa to deliver prepaid debit cards. Venmo and Paypal are reportedly lobbying the government to be considered as a disbursement option.
Future payments?
House Speaker Pelosi is already planning another wave of direct payments to Americans, saying that the $1,200 is not enough to mitigate the economic effects of the pandemic: “I don’t think we’ve seen the end of direct payments.” Republicans, meanwhile, are taking a ‘wait and see’ approach, using the next couple of weeks to measure the impact of the $2 trillion bill passed last week.
House Minority Leader Kevin McCarthy: “What concerns me is when I listen to Nancy Pelosi talk about a fourth package now, it’s because she did not get out of things that she really wanted...I’m not sure you need a fourth package...Let’s let this work ... We have now given the resources to make and solve this problem. We don’t need to be crafting another bill right now.”
For the fourth legislative package, Democrats have said they would like to see increased food stamp benefits; increased coverage for coronavirus testing, visits to the doctor and treatment; more money for state and local governments, including Washington, D.C.; expanded family and medical leave; pension fixes; and stronger workplace protections.
Trump’s signature
Normally, a civil servant signs federal checks, like the direct payments Americans are set to receive. According to a Wall Street Journal report, Trump has told people that he wants his signature to appear on the stimulus checks.

THE SIDES

War on the poor continues

Amid the coronavirus crisis, Trump has defended his continued support of a Republican-led lawsuit to dismantle the Affordable Care Act, which would result in 20 million Americans losing health insurance if successful. The Supreme Court agreed to hear arguments in the case this fall. Contrasting with his position that the ACA is illegal, Trump is considering reopening enrollment on HealthCare.gov, allowing millions of uninsured individuals to get coverage before potentially incurring charges and fees related to COVID-19.
Joe Biden called on Texas Attorney General Ken Paxton, who is leading the charge against the ACA, and President Trump to drop the lawsuit:
“At a time of national emergency, which is laying bare the existing vulnerabilities in our public health infrastructure, it is unconscionable that you are continuing to pursue a lawsuit designed to strip millions of Americans of their health insurance and protections under the Affordable Care Act (ACA), including the ban on insurers denying coverage or raising premiums due to pre-existing conditions.”
The Trump administration is also pushing forward with its plan to kick 700,000 people off federal food stamp assistance, known as SNAP (Supplemental Nutrition Assistance Program). The USDA announced two weeks ago that the department will appeal Judge Beryl Howell’s recent decision that the USDA’s work mandate rule is “arbitrary and capricious."
Additionally: The Social Security Administration has no plans to slow down a rule change set for June that will limit disability benefits, the Department of Health and Human Services still intends to reduce automatic enrollment in health coverage, and the Department of Housing and Urban Development will continue the process to enact a rule that would make it harder for renters to sue landlords for racial discrimination.

Lawmakers’ stock transactions

The Justice Department and Securities and Exchange Commission are beginning to investigate stock transactions made ahead of the economic crisis caused by the coronavirus pandemic. CNN reports that the inquiry has already reached out to Senator Richard Burr for information. “Under insider trading laws, prosecutors would need to prove the lawmakers traded based on material non-public information they received in violation of a duty to keep it confidential,” a task that won’t be easy.
Sen. Burr is facing another consequence of his trades: Alan Jacobson, a shareholder in Wyndham Hotels and Resorts, sued Burr for allegedly using private information to instruct a mass liquidation of his assets. Among the shares he sold were an up to $150,000 stake in Wyndham, whose stock suffered a market-value cut of more than two-thirds since mid-February.

Environmental rollbacks

Using the pandemic as cover, the Trump administration has begun to more aggressively roll back regulations meant to protect the environment. These are examples of what Naomi Klein dubbed “the shock doctrine”: the phenomenon wherein polluters and their government allies push through unpopular policy changes under the smokescreen of a public emergency.
On Thursday, the EPA announced (non-paywalled) an expansive relaxation of environmental laws and fines, exempting companies from consequences for pollution. Under the new rules, there are basically no rules. Companies are asked to “act responsibly” but are not required to report when their facilities discharge pollution into the air or water. Just five days before abandoning any pollution oversight, the oil industry’s largest trade group implored the administration for assistance, stating that social distancing measures caused a steep drop in demand for gasoline.
  • Monday morning update: In an interview with Fox News this morning, Trump said he was going to call Putin after the interview to discuss the Saudi-Russia oil fight. A consequence of this "battle" has been plummeting prices in the U.S. making it difficult for domestic companies (like shale extraction) to turn a profit. It's striking that the day after Dr. Fauci told Americans we can expect 100,000 to 200,000 deaths from COVID-19 (if we keep social distancing measures in place), Trump's first action is to talk to Fox News and his second action is to intervene in an international tiff on behalf of the oil and gas industry.
Gina McCarthy, who led the E.P.A. under the Obama administration, called the rollback “an open license to pollute.” Cynthia Giles, who headed the EPA enforcement division during the Obama administration, said “it is so far beyond any reasonable response I am just stunned.”
The EPA is also moving forward with a widely-opposed rule to limit the types of scientific studies used when crafting new regulations or revising current ones. Hidden behind claims of increased transparency, the rule would require disclosure of all raw data used in scientific studies. This would disqualify many fields of research that rely on personal health information from individuals that must be kept confidential. For example, studies that show air pollution causes premature deaths or a certain pesticide is linked to birth defects would be rejected under the proposed rule change.
Officials and scientists are calling upon the EPA to extend the time for comment on the regulatory changes, arguing that the public is unable to express their opinion while dealing with the pandemic.
“These rollbacks need and deserve the input of our public health community, but right now, they are rightfully focused on responding to the coronavirus,” said Representative Frank Pallone of New Jersey, the chairman of the House Energy and Commerce Committee.
Other controversial decisions being made:
  • A former EPA official who worked on controversial policies returned as Administrator Andrew Wheeler’s chief of staff. Mandy Gunasekara helped write regulations to ease pollution controls for coal-fired power plants and vehicle emissions in her previous role as chief of the EPA’s Office of Air and Radiation. In a recent interview, Gunasekara, who played a role in the decision to exit the Paris Climate Accord, pushed back on the more dire predictions of climate change, saying, “I don't think it is catastrophic.”
  • NYT: The plastic bag industry, battered by a wave of bans nationwide, is using the coronavirus crisis to try to block laws prohibiting single-use plastic. “We simply don’t want millions of Americans bringing germ-filled reusable bags into retail establishments putting the public and workers at risk,” an industry campaign that goes by the name Bag the Ban warned on Tuesday. (Also see The Guardian)
  • Kentucky, South Dakota, and West Virginia passed laws putting new criminal penalties on protests against fossil fuel infrastructure in just the past two weeks.
  • The Hill: The Environmental Protection Agency (EPA) said Friday that it will extend the amount of time that winter gasoline can be sold this year as producers have been facing lower demand due to the coronavirus. It will allow companies to sell the winter-grade gasoline through May 20, whereas companies would have previously been required to stop selling it by May 1 to protect air quality. “In responding to an international health crisis, the last thing the EPA should do is take steps that will worsen air quality and undermine the public’s health,” biofuels expert David DeGennaro said.
  • NYT: At the Interior Department, employees at the U.S. Fish and Wildlife Service have been under strict orders to complete the rule eliminating some protections for migratory birds within 30 days, according to two people with direct knowledge of the orders. The 45-day comment period on that rule ended on March 19.
  • WaPo: The Interior Department has received over 230 nominations for oil and gas leases covering more than 150,000 acres across southern Utah, a push that would bring drilling as close as a half-mile from some of the nation’s most famous protected sites, including Arches and Canyonlands National Parks… if all the fossil fuels buried in those sites was extracted and burned, it would translate into between 1 billion and 5.95 billion metric tons of carbon dioxide being released into the air. That upward measure is equal to half the annual carbon output of China

Court updates

Press freedom case
Southern District of New York District Judge Lorna Schofield ruled that a literary advocacy group’s lawsuit against Trump for allegedly violating the First Amendment can move forward. The group, PEN America, is pursuing claims that Trump “has used government power to retaliate against media coverage and reporters he dislikes.”
Schofield determined that PEN’s allegation that Trump made threats to chill free speech was valid, providing as an example the White House’s revocation of CNN correspondent Jim Acosta’s press press corps credentials:
”The threats are lent credence by the fact that Defendant has acted on them before, by revoking Mr. Acosta’s credentials and barring reporters from particular press conferences. The Press Secretary indeed e-mailed the entire press corps to inform them of new rules of conduct and to warn of further consequences, citing the incident involving Mr. Acosta… These facts plausibly allege that a motivation for defendant’s actions is controlling and punishing speech he dislikes.”
Twitter case
The president suffered another First Amendment defeat last week when the full 2nd Circuit Court of Appeals declined to review a previous ruling that prevents Trump from blocking users on the Twitter account he uses to communicate with the public. Judge Barrington D. Parker, a Nixon-appointee, wrote: “Excluding people from an otherwise public forum such as this by blocking those who express views critical of a public official is, we concluded, unconstitutional.”
Trump-appointees Michael Parker and Richard Sullivan authored a dissent, arguing the free speech “does not include a right to post on other people’s personal social media accounts, even if those other people happen to be public officials.” Park warned that the ruling will allow the social media pages of public officials to be “overrun with harassment, trolling, and hate speech, which officials will be powerless to filter.”
Florida’s felon voting
U.S. District Judge Robert Hinkle ripped into Florida Governor Ron DeSantis’s administration for failing to come up with a process to determine which felons are genuinely unable to pay court-ordered fees and fines, which are otherwise required to be paid before having their voting rights restored.
“If the state is not going to fix it, I will,” Hinkle warned. He had given the state five months to come up with an administrative process for felons to prove they’re unable to pay financial obligations, but Florida officials did not do so. The case is set to be heard on April 28 (notwithstanding any coronavirus-related delays).

ICE, Jails, and COVID-19

ICE
One of the most overlooked populations with an increased risk of death from coronavirus are those in detention facilities, which keep people in close quarters with little sanitation or protective measures (including for staff).
Last week, U.S. District Judge Dolly Gee ordered the federal government to “make continuous efforts” to release migrant children from detention centers across the country. Numerous advocacy groups asked for the release after reports that four children being held in New York had tested positive for the virus:
“The threat of irreparable injury to their health and safety is palpable,” the plaintiffs’ lawyers said in their petition… both of the agencies operating migrant children detention facilities must by April 6 provide an accounting of their efforts to release those in custody… “Her order will undoubtedly speed up releases,” said Peter Schey, co-counsel for the plaintiffs in the court case.
On Tuesday, 13 immigrants held at ICE facilities in California filed a lawsuit demanding to be released because their health conditions make them particularly vulnerable to dying if infected by the coronavirus. An ACLU statement says the detainees are “confined in crowded and unsanitary conditions where social distancing is not possible.” The 13 individuals are all over the age of 50 and/or suffering from serious underlying medical issues like high blood pressure.
“From all the evidence we have seen, ICE is failing to fulfill its constitutional obligation to protect the health and safety of individuals in its custody. ICE should exercise its existing discretion to release people with serious medical conditions from detention for humanitarian reasons,” said William Freeman, senior counsel at the ACLU of Northern California.
Meanwhile, ICE is under fire for continuing to shuttle detainees across the country, with one even being forced to take nine different flights bouncing from Louisiana to Texas to New Jersey less than two weeks ago. That man is Dr. Sirous Asgari, a materials science and engineering professor from Iran, who was acquitted last year on federal charges of stealing trade secrets. The government lost its case against him, yet ICE has had him in indefinite detention since November.
Asgari, 59, told the Guardian that his Ice holding facility in Alexandria, Louisiana, had no basic cleaning practices in place and continued to bring in new detainees from across the country with no strategy to minimize the threat of Covid-19...Detainees have no hand sanitizer, and the facility is not regularly cleaning bathrooms or sleeping areas…Detainees lack access to masks… Detainees struggle to stay clean, and the facility has an awful stench.
Jails
State jails are making a better effort to release detained individuals, as both New York and New Jersey ordered a thousand people in each state be let out of jail. The order applied only to low-level offenders sentenced to less than a year in jail and those held on technical probation violations. In Los Angeles County, officials released over 1,700 people from its jails.
A judge in Alabama took similar steps last week, ordering roughly 500 people jailed for minor offenses to be released to lessen crowding in facilities. Unlike in New York and New Jersey, however, local officials reacted in an uproar, led in part by the state executive committee for the Alabama Republican Party and Assistant District Attorney C.J. Robinson. Using angry Facebook messages as the barometer of the community’s feelings, Robinson worked “frantically” to block inmates from being released.
  • Reuters: As of Saturday, at least 132 inmates and 104 staff at jails across New York City had tested positive for COVID-19, the disease caused by the coronavirus… Since March 22, jails have reported 226 inmates and 131 staff with confirmed cases of COVID-19, according to a Reuters survey of cities and counties that run America’s 20 largest jails. The numbers are almost certainly an undercount given the fast spread of the virus.

Tribe opposed by Trump loses land

On Wednesday, The Federal Bureau of Indian Affairs announced the Mashpee Wampanoag Tribe’s reservation would be "disestablished" and its land trust status removed. Tribal Chairman Cedric Cromwell called the move "cruel" and "unnecessary,” particularly coming in the midst of a pandemic crisis. Rep. Bill Keating (D-Mass.), who last year introduced legislation to protect the tribe's reservation as trust land in Massachusetts, said the order “is one of the most cruel and nonsensical acts I have seen since coming to Congress.”
The administration’s decision is especially suspicious as just last year Trump attacked the tribe’s plan to build a casino on its land, tweeting that allowing the construction would be “unfair” and treat Native Americans unequally. As a former casino owner, Trump has spent decades attacking Native American casinos as unfair competition. The Vulnerable Teen, The Pedophile Online, And The Child Down The Street: Sam Manzie

In the 1990s, America was far less gay-friendly than it is today. While today we take for granted shows like "Modern Family" and "Queer As Folk," in 1997 Ellen Degeneres risked everything when she decided it was time for her and her character on her eponymous TV show to come out and was met with quite a bit of backlash.
At that same time, 15-year-old Sam Manzie was struggling with his sexuality. He'd already told his parents, Nick and Delores, that he might be gay and felt tortured by it. Manzie lived with his parents in Jackson Township, New Jersey, not far from the Jersey Shore. His parents were devout Catholics, raising their children in parochial schools.
Sam struggled with the church's teachings on homosexuality and his internal feelings. He had been struggling with his mental health for some time. He was bullied mercilessly at school for his perceived sexual orientation. Sam was a loner and spent almost all of his free time online after being given a computer by his parents in 1996 at age 14. Samuel A. Manzie was born in California on February 25, 1982, and his parents moved him to South Carolina, then to Florida, and finally to New Jersey in 1987.
The internet was in its infancy in the mid-90s, and Sam frequented gay-themed AOL chat rooms under the username Sam82. He also built a personal website entitled "Me, Myself, & I" that also had a page dedicated to his favorite band, the Smashing Pumpkins. The internet was the only place where Sam felt comfortable and was his only social interaction. This made Sam quite vulnerable to manipulation and unfortunately that's exactly what happened.
The chat room for young gay men Sam frequented was where he met a local man named Steve Simmons. The pair spent hours chatting on AOL and talked endlessly on the phone. Sam told his parents that he was just giving the much older man computer advice. Simmons was 42 and had a long rap sheet of sex offenses.
In 1978 at age 24 he was convicted in Florida of masturbating in front of two brothers aged 7 and 9. After being released from prison, Simmons moved to New Jersey and was again arrested in 1984 for allegedly kidnapping a 17-year-old boy and taking him to Texas.
It turned out that the boy had gone voluntarily, as he'd been (in his words) in a sexual "relationship" with Simmons since he was 13. Two more boys, age 14 and 12, then came forward to accuse Simmons of molesting them, which he was also convicted of. At the time of that arrest, Steve Simmons was working as a camp counselor at a boys summer camp.
In the summer of 1996, Sam and Steve decided to meet up. Sam got his parents to drop him off at the local mall, where he met Simmons in the bathroom. There they engaged in oral sex, and they continued the trysts several times over the next few months.
By the summer of 1997, Sam's behavior at home became more and more volatile. He would punch holes in the walls in anger and cuss out his parents. His parents knew that something was wrong, but they just couldn't figure out what it was. They took him to the doctor to try and get him prescribed medications and checked him into a mental hospital on a couple occasions.
Sam had shown signs of mental illness before. He brought a knife to preschool and had been expelled from school for writing a letter to a male teacher offering to give him oral sex.
At one doctor visit, Sam disclosed his relationship with the pedophile. Unbelievably the doctor felt that it would be detrimental to his mental health to breach Sam's confidentiality and didn’t disclose the ongoing abuse to the police. This was a direct violation of mandated reporter laws. Eventually a different psychologist learned of the abuse and reported it to the police.
The Monmouth County Sheriff's Office decided to use Sam in a sting to catch Steve Simmons. They told him that if he didn't cooperate and use a tape recorder to capture their phone conversations to try and get incriminating statements, they would charge Sam with being an accomplice. Sam agreed and did two phone calls with Simmons uneventfully.
During the third call, Sam snapped. Because he had been manipulated and controlled by Steve, he began to feel that Steve was his only friend and that the police were simply persecuting him and that he was being used by the police. Sam smashed the tape recorder and flew into a rage. In hindsight they didn't really need these tape recordings as with Simmons' past history and Sam's testimony they probably could have gotten a conviction.
After some more acting out, Sam's parents took him to a psychiatric hospital and petitioned the probate court to have him involuntarily committed. Dolores and Nick begged the judge not to send Sam home, claiming that he desperately needed inpatient help.
"We're afraid of Sam. He calls me names with the F-words in them, just like, you know, total disrespect," Nick Manzie told the court.
On September 24, 1997, Judge James Citta sent Sam to a hospital for 24 hours for evaluation and that the next day he would make his decision based on their recommendations. Judge Citta decided to give Sam a lecture about his behavior and inexplicably sent him home with his parents despite their pleas.
The same day, Steve Simmons was arrested and charged with sodomy of a minor. He later pled guilty to a reduced charge and spent 5 years in prison. He was later civilly committed to a facility for sexually violent predators under New Jersey law, where he remains today.
On September 27, 1997, 11-year-old Eddie Werner was walking through his neighborhood selling candy and wrapping paper door-to-door for a school fundraiser. He was hoping to earn the top prize for the most sales: a pair of walkie talkies. Later that afternoon, he vanished. When he didn't come home, his parents called the police, who began searching the neighborhood. Initially police believed that Eddie's father was the culprit and kept their attention focused squarely on him. Little did they know that they had it all wrong and it was much more horiffic than they could have imagined.
That same day, September 27, 1997, Nick and Dolores Manzie inexplicably decided to leave Sam home alone for the afternoon as they went to Atlantic City to gamble at the casinos. As the police went door-to-door asking residents in the neighborhood if they saw Eddie, they knocked on Sam's door. Sam tells the police that Eddie knocked on his door and left after Sam told him he didn't want to buy what he was selling.
48 hours later, a police dog finds Eddie Werner's dead body in the woods. He was found half-naked, face down on the ground with a shoeprint on his back. It was obvious he had been murdered and that there was a sexual element to the crime.
The woods where Eddie was found were behind a home right across the street from Sam's house. They brought Sam in for questioning and told Dolores, his mother, that they were simply trying to rule everyone out as a suspect as a ruse to get her to let them question him. The ruse was unnecessary though. As soon as Dolores heard that a kid from their neighborhood was missing, she immediately suspected that Sam was the culprit.
Dolores asked the detectives to allow her to question her son, believing that if he was responsible that he'd be more likely to confess to her than to detectives. The detectives agreed, and as they watched on CCTV, Delores Manzie sat down and confronted her son in an interrogation room. She started by asking Sam if he'd hurt Eddie. His reply: "No, I killed him." Looking his mother straight in the eye, Sam Manzie spilled the terrifying story of the end of Eddie Werner's life.
Eddie knocked on Sam's door on Iowa Court in Jackson Township, New Jersey at around 5:30 PM. Sam answered the door and profanely told him to get lost. As Eddie walked away, Sam started to get ideas. He thought to himself, I could have that kid and invited him back to the porch. He told Eddie that he needed to retrieve his glasses to examine the merchandise and offered to let him inside the house.
As soon as Eddie got inside, he shut the door behind him and locked it. Realizing that he was in serious danger, Eddie started crying. Sam then brought Eddie up to his bedroom. The more Eddie cried, the more sexually aroused Sam became. Sam ordered Eddie to take off his clothes. Sam raped Eddie by performing oral sex on him. Afterward, Sam ordered Eddie to lay down on the floor and used the cord of his electronic alarm clock to strangle Eddie to death.
Unbelievably this wasn't the end of the vicious attack. Sam went to his parents' bedroom to retrieve their Polaroid camera and he took a picture of Eddie's naked dead body. Sam then stuffed Eddie's body into a suitcase, took it outside, and left it on the back porch. As the search for Eddie commenced, Sam watched where the search party was. He went to an area in the woods that police had already searched and dumped his body there.
Police arrested Sam Manzie and charged him with murder. Initially Dolores didn't believe her son's story. After Sam's confession, police executed a search warrant of the Manzie home. The police initially didn't find the Polaroid photo that Sam had taken. Dolores found the photo as she was cleaning the house after the police left and was left with indisputable evidence that her son really was a cold-blooded child rapist and murderer.
Sam's parents insisted that he plead not guilty by reason of insanity and go to trial. They believed that this crime wasn't the real Sam and that his demons and mental illness had simply gotten the better of him. While in jail awaiting trial, Sam was put on three different drugs to control his depression and anxiety. Nick Manzie protested that the drugs were making him too lucid for a judge and jury to see how ill he was and that they wouldn't fully consider the impact of his mental illnesses on the crime.
On March 20, 1999, Sam Manzie pleaded guilty to the murder of Eddie Werner. In exchange for his guilty plea, prosecutors dropped all of the charges regarding the sexual assault committed on Eddie before the murder (which Sam had not directly admitted to). Sam faced a minimum of 30 years in prison, and up to life without parole.
On April 14, 1999, Sam Manzie was sentenced to 70 years in prison. At the time, a new law passed as a result of the "get tough on crime" sentiment expressed by the public at the time would have required Sam to serve almost all of his sentence.
In the years since, laws have changed in New Jersey regarding juvenile sentences. According to the New Jersey Department of Corrections, Sam Manzie will be eligible for parole on September 30, 2027. If he is not paroled, he will be released on September 10, 2033. He is currently incarcerated at the New Jersey State Prison in Trenton, New Jersey.
Steve Simmons and Sam Manzie wrote letters back and forth in jail in the first few years after the murder. Simmons later said in a 1999 interview that if he hadn't been arrested and locked up for molesting Sam, that Sam would have turned to him for support and that he would have talked him out of killing Eddie.
"If the bail was less, Eddie Werner would have been alive today. Sam would have called me that Saturday and Eddie Werner wouldn’t have been killed. This is the most famous blowjob of the 20th century after Monica Lewinsky," he said. "I’m not an angel, but I’m being the fall guy for the other crime."

Stand Design: The Stand is rather tall and bulky. It has black and white checker patterns across its arms up to the wrists. Its hands were white, with the numbers "50" on the top of each hand. Character: Arthur D'arby had a choice to make at the age of 14. Either he would stay with his mother who taught elementary school in California or move with his real estate father down to Vegas. Arthur decided to choose his father, Terry D'arby. He brought his son to his suite, where for the next 4 years he would stay as his father got drunk and gambled at the resort under there. He would lose contact with his mother as soon as he moved in with him, as she faded from his personal life. During this time his stand would grow to what it would be. Arthur hated it at first, seeing it as a constant reminder of his poor choice all those years before. He was then relieved to hear at the age of 18, while he was strolling down the casino slots his dad would go to that his dad got drunk again Saturday night and wandered into the streets. Arthur packed his things and whatever cash his father had and left Vegas. He still had unfinished business however, and moved to California again to search for his missing mother. However, he learned of her fate. Soon after the divorce, she got together and married a prosecutor, who also had a 4 year old girl. Not too long after the couple had a child, and moved to a quiet secure neighborhood. A few days before his father's death, a convict the prosecutor got to prison escaped and killed all the family members. Arthur stood on his mother's grave, and laughed hysterically. He laughed with tears in his eyes, seeing the choice he made didn't leave him dead. He left her grave, coming to the realization that life is a gamble. If he would die one day to a decision he will make, he'll make sure to put the odds on an equal playing field. He would take this philosophy to his new job as a human.
Conditions: No condition
Ability: Jester's Life is a stand with the ability of 50/50 probability. All actions within its one meter range have a 50% possibility of coming true. Should it fail, it's reciprocal action will take effect. While the reciprocal action can leave the user in a bad place or leave them stuck in bad situations, the user is knowledgeable enough to not phrase things in a way that wpuld put them in a bad position should it fail.
(Example: "This bullet will go through this man's head." Its reciprocal version is "This bullet will not go through this man's head.")
Despite the ability, there are rules as to how the ability can be used.
Rule 1: The action must be spoken verbally before done to have the ability to use the 50% probability.
Rule 2: All probabilities must already have a 0.001% chance of happening to be able to give it a 50% shot
Rule 3: The ability cannot directly harm another person unless they are working under the influence.
(Example: "This person will have a heart attack" cannot work unless the person is in the range of the stand)
Rule 4: If the spoken message isn't detailed enough, the probability will not work.
Rule 5: If a 50/50 fails, the user cannot use the ability to try again, as the reciprocal half would be in effect. This can be worked around, however, if new items are used in the 50/50 or the spoken action was detailed enough so that altering it a bit allows for a another try.
Results of the probability will 100% happen once decided. The effects are also continuous until the Stand user is dead or the task was completed.

[TX] Wife has disappeared for almost a week now

My wife and I have always had a bit of a rocky relationship. She has a gambling problem that she has not made many strides to address and was a major factor in our decision to move from CA to TX last October. Since the move, she has had a couple of nights of "going out with friends" that ended up with her driving the ~5 hours necessary to get out of state to a casino in either OK or LA, but this week takes the cake.

On Monday 6/3, she rented a car since we currently only own one and then drove to Louisiana and basically fell off the map. In that time she burned through all of the money in our shared account and I'm assuming hers as well. I also found out in the past few weeks that the paychecks that she had deposited into my personal account have bounced because I assume she used mobile deposit and then cashed them elsewhere. She would not respond to any texts or calls on Monday but finally FaceTimed our daughters on Tuesday. Since then it has been a lot of nothing. She hasn't been home at all and judging by the iMessages I see on her iPad at home she has been hitting up anyone and everyone she can to borrow money to try to recoup her losses from this recent binge. I have been able to continue taking the kids to daycare and doing the part time job that I have currently, but this will not be sustainable for long. Our mortgage payment is due on the 15th and I also found out that since she hasn't shown up to her job at all that she's been let go from there. This puts additional hardship upon us since hers is the primary income of the household currently.

We have two daughters together, aged 2 and 3. I have declarations of paternity from the state of California for both of them, but the real wrinkle is that I've also been taking care of my stepson during this. He is 11 and I have no legal guardianship of him.

My question is this: what are the first steps I need to take to establish a custody order and begin the process of separating myself from this giant collection of mistakes I've made? I realize that seeking sole conservatorship of the girls will be an uphill battle in Texas, but I do have documentation of her absence over the past week and it shouldn't be too hard to establish her neglectful behavior. Any advice or resources would be greatly appreciated.

  • Bret Hart officially gave notice to WWF this week that he's leaving and has agreed to a 2-year deal with WCW. Hart has reportedly been unhappy with WWF's new, more crude direction and that, more than money, is reportedly why he chose to leave, but of course, money played a big part also. But Hart is reportedly so embarrassed by the current WWF direction that he doesn't even let his children watch the show and of course has been upset at having to deal with Shawn Michaels. Both Hart and WWF tried to keep the story under wraps until after Survivor Series but that's impossible these days. Once the story leaked, WWF released a statement admitting that they were giving Hart the opportunity to explore other options. On Nitro, Eric Bischoff teased that he would have a big announcement next week, which would be Hart coming to join the NWO (which would probably be turned into a storyline with him deciding if he's with WCW or NWO). For now, Bret is scheduled to work all his WWF booked events through the end of November and then one final PPV show in December. Hart and Bischoff have reportedly been negotiating for about 6 weeks, and very few people knew. They met in person 3 weeks ago and at that point, they were pretty sure Bret was coming to WCW but he didn't make the final decision until this weekend. During his WWF negotiations last year, Hart got Vince to agree to a clause in his 20-year contract that allows him to quit with 30 days notice and another clause that gives him creative control over his character during those final 30 days.
  • All that is known about Hart's WCW deal is that it's similar to the contract he turned down last year, although slightly less money because Hart insisted on working fewer dates (around 125-140 per year) due to a bad knee that never really healed last year and a wrist injury that he's long needed surgery on. It also has the same deals with Hart getting movie roles for Turner. Bret will likely be used to help prop up the new Thursday TBS show as well as help WCW grow in Canada. Dave recaps the last year, saying Bret quickly became unhappy in WWF after signing his new deal, and pretty much came up with his own angle for the double-turn with Steve Austin and with forming the Hart Foundation. He also has well-known heat with Shawn Michaels dating back to last year but got much more heated this year with Shawn's "Sunny days" comment followed by a legit backstage fight that led to Shawn walking out of the company. Neither man was punished for the fight and in fact, WWF basically begged Shawn to return. Eventually they agreed to co-exist and leave personal lives and families out of their promos, but Shawn then did an interview talking about Stu Hart. Shawn later apologized for that one, saying he got carried away in a promo. Shawn has been on a self-destructive path the last year and his immaturity and antics on TV are seemingly encouraged by Vince McMahon, which upset Bret. And the final straw appears to be Vince deciding that Bret will drop the title to Shawn at Survivor Series.
  • There's been speculation that Vince McMahon actually wants Bret to leave because he doesn't want to honor the 20-year contract that Bret has because he has buyer's remorse. McMahon fought hard to keep Bret from WCW last year and many think he was only thinking in the short-term when he made the deal. Long-term, it's a very expensive contract that doesn't make good economic sense for WWF which has led to people questioning whether or not Vince is actively trying to push Bret to leave. Asking him to drop the title to Shawn was sure to upset him and Vince knew it. Dave says no one knows exactly what will happen in Montreal at the PPV. Most people will expect Bret to drop the title, but they may try to swerve fans and do it at another time. But either way, Bret will have to drop the belt sometime very soon. As for guys like Owen Hart and Davey Boy Smith, they're both locked into 5 year contracts and it doesn't look like any of this will affect their status with the company.
  • And on a final note, just a few days ago, Bret Hart wrote a column in the Calgary Sun paper which is designed as a "letter" to Shawn Michaels that was meant to seem like a shoot in order to promote the Survivor Series match. But knowing what we know now, it takes on a whole new meaning (I'm sure Bret meant every word of this):
"Shawn Michaels, you are a disgrace to professional wrestling. It amazes me that there was a time I actually thought you'd be the guy who could come up behind me and carry the ball when my time comes to retire. Now when you're behind me, I have to make sure I don't bend over. I am a second generation wrestler. Like a lot of second generation wrestlers, I've paid my dues. The way you are degrading the business makes me sick and breaks my heart. That's not what Heartbreak Kid was supposed to mean. I told you, and Vince told you, to leave our families out of this. So you got on RAW and said that my father is dead. This time you're so far over the line that there's no coming back. Every so often, after you shoot off your mouth, you come to me backstage with a lame apology and a limp handshake. "Oh Bret, my mouth always gets me in trouble when I get goin' out there. You know I didn't mean nothin' by it."
Don't bother this time, I'm not buying it. I would not embarrass my father--who is not only very much alive but is still tougher today at 83 and more of a man than you will ever be--as you have embarrassed your father with your degenerate behavior. How humiliating for your poor mother to have to explain your lewd gestures to her friends. You don't respect anybody, do you? What does Jose Lothario think of how you've made pornography out of what he taught you? Shawn Michaels, you are nothing more than a whore for this business.
You called me a paper champion because it bothers you that my contract is worth more than you and the whole Degeneration X put together. You said I wrestle because I need the money, but you wrestle because this business needs you. You are a festering cancerous tumor in this business. After Wrestlemania XII, I went home for a while to give you the chance to become "the man" because as long as I'm around you'll never be "the man." You were so bad at being "the man" that the WWF and WCW had the biggest bidding war in wrestling history to get me to come back. You'd have the World championship belt. But you don't. What do you have, besides a big mouth and a bad attitude?
Shawn Michaels, you said that beating the Undertaker makes you an icon. Not taking anything away from 'Taker, but you weren't the first guy to beat him, you just did it too late. You said you're the only icon that can still go, not like the fossils. You're so beat up from taking completely overdone bumps like a Mexican jumping bean that you can't even work a full schedule like the older guys. You only wrestle about once a month and you're proud of that? Then people who think they know more about this business than they actually do, write about what a hard worker you are. Anyone can work hard once a month. You've barebacked your way to main event matches and they give you the best guys in the business to make you look good.
So you and your boyfriend, Hunter, think I'm too old. Hunter said he's bigger than me in more ways than one, and then you pointed at Hunter's crotch and said he could put an eye out with that thing. Thanks for admitting that you know what Hunter has in his pants. So how come I have four kids and all you two have is each other? I'm not the one shooting blanks. By the way, you both looked very comfortable eating bananas together on Raw. Lots of parents tell me they won't let their kids watch the shows anymore because of you and they don't watch either because you're such an asshole. People are shutting the show off because of you! It took so long to make wrestling into family entertainment. Thanks for setting the business back 50 years! You are the one who is confusing expansion and destruction, not me. You, Shawn, are the destruction of this business. You make me sick. You said you're the best sports entertainer in the world. Don't even think about saying you're a wrestler. What I do is an art form and what you do is...what do you do, anyway, cause it's not pro wrestling anymore?
You called the WWF world championship a "tin title" but you're only saying that because you don't have the belt. When you did have it, you treated it like garbage and then threw it away! So now you want to try to win the title at Survivor Series? You'd better reconsider that because when I get my hands on you it's going to make the beating I gave you in the locker room last June look like a warm up. After that little scuffle, you went running to Vince, complaining that the work conditions in the WWF are unsafe. The only thing unsafe about the working conditions in the WWF is you, Shawn. You've gotten in the ring so "pilled up" lately that you can't even talk straight on TV. You'd better shake the cob webs free before you get in the ring with me at SS. This business has been my mistress for my whole life and I love her. You are raping her and taking her dignity away. Don't count on my reputation for professionalism saving your ass at SS. You're the one who threw the rule book out the window. The 17 stitches you got at Hell in the Cell are nothing compared to what's coming at Misery in Montreal."
  • Ric Flair has also agreed to re-sign with WCW which is a win for them because WWF was very interested and Flair had strongly considered it for awhile. But he'll be staying with WCW.
  • The official cause of death for Brian Pillman has been released and the verdict is heart attack due to natural causes. Reportedly, after a month of tests, the coroner was stumped for a cause of the heart attack, although his heart did show an unusual amount of damage for someone his age. It could be hereditary or due to outside factors such as cocaine or steroids, both of which it's no secret that Pillman had used and abused during his career. Toxicology results didn't show any drugs in amounts that could have killed him. He had painkillers in his system but not at dangerous levels. No steroids or illegal drugs were found in his system, nor any alcohol. He had blood pressure medication in his system, which he didn't have a prescription for but again not at a dangerous amount. On a WCW internet radio show a couple of weeks ago, Gene Okerlund claimed to have an inside scoop with sources with the police in MN that cocaine was the cause of death, which got rumors going. But when toxicology showed no cocaine in his system, this naturally led to a ton of heat on Okerlund and upset a lot of people.
  • Gorilla Monsoon's condition improved over the weekend but he's still hospitalized and listed in serious condition. Monsoon was on a respirator and receiving kidney dialysis for most of the last week. Doctors are hoping to perform a bypass surgery on his heart soon, but it no longer looks as though he needs a transplant for now. Monsoon had been a top heel back in the day and was part owner of Capital Sports (parent company of the old WWWF) before selling his share of the company to Vince McMahon Jr. in 1982. Ever since then, he's remained with the company as an announcer, figurehead authority figure, and backstage office roles as well as giving time cues at TV tapings from the other side of the curtain.
  • NJPW "only" drew around 40,000 to their latest stadium show in the Fukuoka Dome, which is the smallest crowd ever for a NJPW stadium show. The number disappointed many, and it seems to be a reality check about the long-term future of NJPW, which has been the most successful promotion in the world for the last few years, but is starting to see the peak fading. Right now, they're being carried by the final retirement shows of Riki Choshu which are doing big business, but after he retires on Jan. 4th, NJPW doesn't really have anything exciting on the horizon for 1998, which has some in the company worried.
  • Two incidents with fans at wrestling shows made news this week and led to near riots. The first was at a Promo Azteca show in Tijuana. A bunch of wrestlers were in the ring having a big post-match brawl. Among them were Rey Misterio Jr., Psicosis, Konnan, and others when a fan hit the ring and did a dropkick on Misterio. Then another fan ran in and hit Mistero with a chair, but Misterio got the chair away from the fan. At this point, fans in the crowd all started throwing chairs at the ring and, sensing a riot about to break out, others in the crowd panicked and began running. All in all, it was a scary situation but nobody was hurt. For what it's worth, WCW doesn't want Misterio wrestling in Mexico anymore because they don't want him to get hurt, especially at a non-WCW show.
  • The other incident took place in (where else?)....ECW at a show in Plymouth, PA. This situation was different. According to several witnesses, a small group of fans showed up, all big tough looking guys, and they were there looking for trouble right from the beginning. They were harassing the wrestlers all night from the front row and during the first match, security came and told them to stop leaning over the rails and stop spitting at wrestlers, but the security guard was shouted down by the group. Why they weren't removed then and there, no one knows. The ECW wrestlers mostly tried to avoid wrestling near them. But then Axl Rotten, Balls Mahoney, John Kronus and (who else?) New Jack came to the ring for a match. And then trouble began. When Balls Mahoney got too close, 2 of the fans started punching him. Mahoney turned around and started throwing wild punches back and then the ECW locker room emptied as everyone ran out to join the brawl. "Reports are the Dudleys were going through the crowd like buzzsaws" and it took nearly 20 minutes to bring order back to the show. After it was over, several hundred fans were outside the building trying to escape the near-riot. Several fans were injured, although none seriously. 40 police officers, some in riot gear, and even a police dog showed up to the scene. The story made all the local news outlets. Balls Mahoney and New Jack were brought to the police station for questioning. The 2 fans who threw the initial punches were arrested and charged with assault, disorderly conduct, and harassment. New Jack surprisingly didn't do much during the fight because as soon as it started to break out, Paul Heyman ran out and pulled New Jack away from it because given the Mass Transit legal situation, Heyman didn't want him getting into more legal trouble that could reflect on the company.
  • Speaking of fans getting involved, WWF ran an angle on Raw with a "fan" getting into the ring who then started doing martial arts and kicking people's asses. He is former Stampede wrestler Steve Blackman and he's expected to officially debut in his first match at Survivor Series, replacing The Patriot on Team USA.

  • Dave reviews a recent FMW show and says the show-stealer was Masato Tanaka vs. The Gladiator (Mike Awesome) and says usually they're both decent workers at best but they really clicked in this match. (Indeed they did. Those 2 had the best chemistry together and they went on to have legendary matches against each other in ECW and even revived the feud years later at the first WWECW One Night Stand PPV). Anyway, this FMW match even has their famous powerbomb-outside-the-ring spot at about the 18 minute mark.

  • The Dallas Sportatorium got a new lease on life after reports came out that it would be torn down. Enough die-hard wrestling fans who still attend the occasional indie show there made enough noise that they extended the lease on the building and it won't be torn down for now.
  • USWA is dead, but Jerry Lawler had a contract to run weekly shows at a casino in Mississippi, so he's continuing to run indie shows there each week so as to not to violate the contract. In Louisville, Ian Rotten's IWA is trying to take over the TV deal and arena dates that USWA had. And Bert Prentice's Music City Wrestling is trying to take over the Memphis and Nashville deals and they'll be running their first show in Memphis next week on the usual USWA date at the same building.
  • A few weeks ago, Billy Jack Haynes emerged from hiding (reportedly because he had some bad gambling debts and was kinda on the run) and tried to make amends with people he had screwed over. He admitted having a gambling problem but said it was all behind him now. He borrowed some money from a few people to get his life back in order.....but has instead disappeared again after borrowing the money.
  • The rap group Insane Clown Posse will be wrestling at a show called Stranglemania Live in Detroit next month. The show will also feature a women's thumbtack death match. (The video below is part one. Part 2, 3, 4, etc. should start automatically after you finish the previous one).

  • ECW held a show in Stamford, CT on Halloween that sounds like it was a lot of fun. A lot of current ECW stars who used to work in WWF used their old WWF gimmicks since it was Halloween. Al Snow came out as Avatar, Justin Credible worked as Aldo Montoya, Jerry Lynn worked as Mr. J.L., Shane Douglas did his Dean Douglas gimmick and Chris Candido came out as Skip. Also on the show, Rob Van Dam dressed as Sabu. The BWO guys (Blue Meanie and Super Nova) wrestled as Big Daddy Fool and the Heartburn Kid, coming out to Shawn Michaels' music. Finally, Tommy Dreamer won a flag match and proclaimed Stamford as ECW country (no free video anywhere but apparently you can pay to watch it here on Highspots).

  • Tickets for Sting vs. Hogan at Starrcade go on sale this week and it's almost certainly going to break every record in WCW history. The Halloween Havoc show last month did a big PPV buyrate also. Dave says a lot of people have talked about how terrible the Hogan/Piper "age in the cage" match was, and they're right, it was awful. But the job of the top stars is to sell tickets and when it comes to that, Hogan is still #1 in WCW, no matter how bad the match was. Even Hogan's new movie Assault on Devil's Island did a 4.2 rating, making it one of the most-watch made-for-TV movies ever on cable and they may be turning the movie into an ongoing TV series.
  • Dave thinks the political situation in WCW will be interesting in 1998. All of the top stars (Hogan, Sting, Flair, Piper, Savage, Hall, Nash, and soon, Bret Hart) will be under the same roof and all of them have or will have some measure of creative control in their contracts which is sure to lead to some problems. With WWF losing Bret Hart, that frees up a lot of money so don't be surprised to see some of those guys maybe looking to go back to WWF if things get too crowded at the top.
  • Raven cut a promo on Nitro and mentioned sitting next to a girl named Trisa Hayes in elementary school. That's an inside reference because Trisa Hayes is actually the real name of ECW's Beulah McGillicutty.
  • Perry Saturn won the TV title on Nitro, and because his knee is still not fully healed, he wrestled a totally different style, sorta similar to Taz with lots of suplexes and submissions. Taz got wind of this and was reportedly upset that Saturn was stealing his gimmick but Dave says they're different enough that he wouldn't really consider it the same.
  • WCW Injury Report: Bill Goldberg has a pulled groin and will miss a few shows. Syxx had an MRI on his neck and the results weren't good, as he had more damage than originally thought. He'll be out for awhile, no word how long. DDP had blood in his urine recently but didn't miss any matches. Marcus Bagwell will be out for a few weeks after having the meniscus in his knee removed. And even Kimberly Page knocked heads with another Nitro girl during a mistimed routine and was banged up.
  • Southern California indie wrestler Christopher Daniels is expected to get a WCW tryout soon.
  • WCW filed a lawsuit against WWF over them using the name Canadian Stampede for its PPV back in July because they claimed it was too similar to WCW's Spring Stampede PPV name. The case was settled out of court, but not for money. Part of the agreement is WWF wouldn't use the name Canadian Stampede in the future.
  • DDP raised about $1,000 for Brian Pillman's family through internet donations.
  • Steve Austin has been working 8-man tag matches on house shows and doing very little in the ring. Doctors are still giving him bad diagnosis but its hard for someone to stop and give up their career when they're at their peak like Austin is now (we're not even close to Austin's peak yet).
  • Doctors have told The Patriot he should retire due to his tricep tear because it seems to be a chronic problem. He's expected to get surgery and if he decides to return, it'll be in 3-6 months (he didn't return).
